Our policy
Serial Nook respects the rights of creators and responds to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We remove or disable access to material that is claimed in a valid notice to be infringing, and we may notify the person who posted it.
How to file a notice of infringement
To report content under 17 U.S.C. § 512(c)(3), send our designated agent a written notice that includes all of the following:
1. Your physical or electronic signature, as the copyright owner or a person authorized to act on the owner's behalf.
2. Identification of the copyrighted work you claim has been infringed.
3. The exact URL of each page on this site that contains the material you claim is infringing, so that we can locate it.
4. Your name, mailing address, telephone number and email address.
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
Designated agent
Send notices to our Designated Copyright Agent, email [email protected]. Please use these details for copyright notices only; other messages may not receive a response.
Counter-notification
If your content was removed and you believe that was a mistake or that you have the right to post it, you may send a counter-notice under 17 U.S.C. § 512(g) that includes: your physical or electronic signature; identification of the material removed and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed because of mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal district court for the judicial district of your address (or, if outside the United States, any judicial district in which the Service may be found) and that you will accept service of process from the person who filed the original notice.
If we receive a valid counter-notice, we will forward it to the complaining party. Unless that party notifies us within 10 business days that it has filed a court action, we may restore the material in not less than 10 and not more than 14 business days after receiving the counter-notice.
Repeat-infringer policy
In appropriate circumstances, we terminate the accounts of users who are repeat infringers. A user who has been the subject of multiple valid notices of infringement that were not successfully countered may have their account terminated and their content removed.
Misrepresentations
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. Please consider whether the use may be a fair use before you send a notice.
